Terms of Service

Welcome to FaithLink. These Terms of Service ("Terms") govern your access to and use of the FaithLink mobile application, website, and services (collectively, the "Service"), operated by FaithLink Ltd. ("we", "us", or "our").

By creating an account, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service. We may update these Terms from time to time. Material changes will be notified via the app or email at least 14 days before taking effect. Continued use after changes constitutes acceptance.

You must meet ALL of the following criteria to use FaithLink: • Be at least 18 years of age. We do not knowingly allow minors to register. • Be legally single, separated, divorced, or widowed — not currently married or in a legally binding domestic partnership that you are seeking to circumvent. • Have the legal capacity to enter a binding contract in your jurisdiction. • Not be previously banned from the Service for violations of these Terms or community standards. • Register using your real identity. Pseudonyms, impersonation, or false representation of age, marital status, or identity are strictly prohibited.

We reserve the right to verify age and marital status and to suspend any account where eligibility is in doubt.

To use the Service, you must register an account. You agree to: • Provide accurate, current, and complete information during registration. • Maintain and promptly update your account information to keep it accurate. • Keep your password and login credentials confidential and secure. • Notify us immediately of any unauthorized access or security breach. • Be fully responsible for all activities that occur under your account.

We strongly encourage enabling biometric/passkey authentication where available. You may not share, sell, rent, or transfer your account to another person.

You retain ownership of all text, photos, voice recordings, videos, and other materials you submit ("User Content"). By posting User Content, you grant FaithLink a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in connection with operating and promoting the Service.

You represent and warrant that: • You own or have the necessary rights to your User Content. • Your User Content does not violate the intellectual property, privacy, or publicity rights of any third party. • Your photos and videos are of you (not stock images, AI-generated faces misrepresented as real, or photos of other people).

We may review, screen, and remove User Content at our discretion, particularly if it violates these Terms or community standards.

FaithLink is a community built on respect, honesty, and shared Christian values. You agree NOT to: • Harass, bully, intimidate, stalk, or threaten any user. • Share sexually explicit, pornographic, or obscene content. • Promote hate speech, discrimination, or violence against any group based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic. • Impersonate any person or misrepresent your identity, age, marital status, or intentions. • Solicit money, engage in scams, pyramid schemes, or commercial prostitution. • Use the Service for any illegal purpose or in violation of any local, national, or international law. • Create multiple accounts, use bots, scripts, or automated systems to interact with the Service. • Circumvent or attempt to circumvent our safety, moderation, or security measures. • Share personal contact details in a manner designed to bypass our platform safety systems before establishing trust.

Any content or behavior involving child sexual abuse or exploitation (CSAE) is strictly prohibited and will result in immediate permanent ban and referral to law enforcement. Read our full CSAE Policy here: https://faith-spark-union.lovable.app/csae-policy

Violations may result in content removal, temporary suspension, or permanent account termination without refund. We cooperate fully with law enforcement regarding illegal activity.

FaithLink offers both free and premium subscription plans ("FaithLink Plus"). By subscribing: • You agree to pay all fees associated with your chosen plan. • Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before renewal. • You may cancel anytime via your device's app store settings (Google Play or App Store) or through the Billing section in Settings. We do not process cancellations directly. • All payments are processed by Apple App Store or Google Play. We do not store your full payment card details. • Prices are displayed in Kenyan Shillings (KES) or your local currency and are inclusive of applicable taxes unless stated otherwise. • Refunds are handled according to the policies of the respective app store. We do not provide partial refunds for unused subscription periods unless required by applicable consumer protection law. • If your payment fails, we may retry billing. Failure after retries will result in downgrade to the free plan.

You may delete your account at any time via Settings → Danger Zone → Delete Account. Deletion is permanent and irreversible. All your profile data, messages, photos, matches, and activity history will be removed from our active systems within 30 days, except where we are legally required to retain certain records (e.g., payment transaction logs, abuse investigation data).

We may suspend or terminate your account, with or without notice, if we believe you have violated these Terms, endangered other users, or engaged in fraudulent or illegal conduct. Upon termination, your license to use the Service ends immediately. Provisions that by their nature should survive termination (including intellectual property, disclaimers, and liability limitations) will survive.

The Service, including its design, code, logos, trademarks, text, graphics, and software, is the property of FaithLink Ltd. and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our express written permission.

The "FaithLink" name, logo, and related marks are trademarks of FaithLink Ltd. You may not use them without prior written consent.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not guarantee: • That the Service will be uninterrupted, timely, secure, or error-free. • The accuracy, completeness, or truthfulness of any user profile or content. • That you will find a compatible match or achieve any particular relationship outcome. • That any user is who they claim to be. We provide tools for reporting and verification but cannot guarantee identity authenticity.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FAITHLINK LTD. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING OUT OF YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED US DOLLARS (USD $100), WHICHEVER IS GREATER.

You acknowledge that meeting people online carries inherent risks. Always meet in public places, tell someone where you are going, and prioritize your personal safety.

You agree to indemnify, defend, and hold harmless FaithLink Ltd., its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: • Your access to or use of the Service. • Your User Content. • Your violation of these Terms. • Your violation of any rights of another person or entity.

These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If not resolved within 30 days, the dispute shall be settled by binding arbitration in Nairobi, Kenya, under the rules of the Chartered Institute of Arbitrators (Kenya Branch). The arbitrator's decision shall be final and binding. Each party shall bear its own costs, and the arbitration fees shall be shared equally, except where a party prevails on a claim that the other party's conduct was frivolous or vexatious.

Nothing in this clause prevents either party from seeking injunctive or equitable relief in a court of competent jurisdiction for matters relating to intellectual property rights or confidentiality.

The Service may contain links to third-party websites, services, or advertisements that are not owned or controlled by FaithLink. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party services. You access them at your own risk.

We use third-party service providers for hosting, analytics, push notifications, payment processing, and email delivery. Your use of the Service is also subject to the terms and policies of these providers where applicable.

If you download the FaithLink app from the Apple App Store or Google Play Store, you acknowledge that these Terms are between you and FaithLink Ltd., not with Apple or Google. Apple and Google are not responsible for the Service or its content. In the event of any conflict between these Terms and the App Store Terms of Service, the App Store Terms shall govern only to the extent of the conflict, and only with respect to your relationship with Apple or Google.

We may modify these Terms at any time. We will notify you of material changes via an in-app notice or email at least 14 days before they take effect. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms. If you do not agree, you must stop using the Service and delete your account.
